Copyright Dispute Policy

Trustpilot has adopted the following general policy toward copyright infringement in accordance with the Digital Millennium Copyright Act or DMCA (posted at www.lcweb.loc.gov/copyright/legislation/dmca.pdf). The address of Trustpilot’s designated agent which receives notices and counter-notices under this policy (“Copyright Agent”) is listed at the end of this policy.  

When we say “Trustpilot”, “we”, “our” or “our platform” we mean our review platform hosted at Trustpilot.com, any sub-domain, sub-directory, similar platform, website or mobile app operated by us and provided to you, including any information, text, reviews, comments, images, data or other content contained on or related to the above.

It is our policy to (1) block access to or remove material that we believe in good faith to be copyrighted material that has been illegally copied and distributed by any of our advertisers, affiliates, content providers, members or users; and (2) remove and discontinue service to repeat offenders. 

1. Procedure for Reporting Copyright Infringement

If you believe that material on our platform infringes a copyright, please send a copyright infringement notice containing the following information to the Copyright Agent (“a notice”):

a. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed;

b. Clear identification of works or materials alleged to have been infringed;

c. Clear identification of the material that is claimed to be infringing, including information that will allow us to locate the allegedly infringing material that the copyright owner seeks to have removed e.g. a URL; 

d. Contact information about the notifier including address, telephone number and, if available, email address;

e. A statement that the notifier has a good faith belief that the material identified in (c) is not authorized by the copyright owner, its agent, or the law; and 

f. A statement made under penalty of perjury that the information provided is accurate and the notifying party is authorized to make the complaint on behalf of the copyright owner. 

Once a notice is received by the Copyright Agent, it is Trustpilot’s policy:

  • to remove or disable access to the allegedly infringing material; and

  • to notify the alleged copyright infringer and the original complaining party that it has removed or disabled access to the material.

2. Procedure to Supply a Counter-Notice to the Copyright Agent 

If the alleged copyright infringer believes that the material that was removed (or to which access was disabled) is not infringing, or they believe that they have the right to post and use such material from the copyright owner, the copyright owner’s agent, or, pursuant to the law, the alleged copyright infringer, can send a counter-notice. 

We will provide a form for completing a valid counter-notice in our email informing you that we have removed or disabled access to the allegedly infringing material. If you'd prefer not to use this form, please send a counter-notice containing the following information to the Copyright Agent (“a counter-notice”):

a. A physical or electronic signature of the alleged copyright infringer;

b. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled (this information will be included in our email informing you that we have removed or disabled access to the allegedly infringing material);

c. A statement that the alleged copyright infringer has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material; and

d. The alleged copyright infringer’s name, address, telephone number, and, if available, email address, and a statement that such person or entity consents to the jurisdiction of the Federal Court for the judicial district in which the alleged copyright infringer’s address is located, or, if the alleged copyright infringer is located outside the United States, for the Southern District of New York, and that such person or entity will accept service of process from the person who provided notification of the alleged infringement or an agent of such person.

If a counter-notice is received by the Copyright Agent, we may send a copy of the counter-notice to the original complaining party informing that person that we may reinstate the removed material or cease disabling it in 10 business days.  Unless the copyright owner files an action seeking a court order against the alleged copyright infringer, the removed material may be replaced or access to it restored in 10 to 14 business days or more after receipt of the counter-notice, at our discretion.

3. Repeat Infringers Policy

If you repeatedly post content that infringes copyrights or other intellectual property rights, or we repeatedly receive notices of you doing so, we may, in appropriate circumstances and at our sole discretion, terminate your account. 

4. Appeal Account Termination

If your account was terminated due to breaking the above repeat infringers policy and you think the circumstances mean that your account should be put back, you can appeal the decision. To appeal the decision, follow the instructions provided in the email informing you of the termination, with an explanation of why you believe your account was wrongly terminated. We only put accounts back under compelling circumstances so please provide detail and be truthful if you appeal.  We will review your appeal and take appropriate action.
